These terms cover your use of hexa.partners and anything you buy on it. Please read them before you buy.
If you join ESC, two more documents apply as well:
Our privacy notice explains how we use your personal data.
1. Who we are and how to reach us
The site is run by Hexa Partners & Technologies Sdn. Bhd. (202201046763 / 1492460-M), a company registered in Malaysia. In these terms, “Hexa Partners”, “we”, “us” and “our” mean that company. “You” means the person using the site or buying from us.
- Registered office: H-16-02A, Mutiara Ville, Persiaran Bestari, Cyber 11, 63000 Cyberjaya, Selangor, Malaysia
- Email: hey@hexa.partners
- WhatsApp support: +60 11-1535 3462
2. Using the site
You can use the site to learn about our work, take the free diagnostic, join a waitlist, subscribe to our newsletter and join ESC.
Please don’t:
- send automated requests, or misuse our forms
- try to get around our security checks or limits
- open a private link that wasn’t sent to you
- copy large parts of the site to reuse or sell
- use the site to break the law or to harm anyone
We may block requests that look like abuse.
3. Private links
Some pages open from a private link we email you: your diagnostic report, your member page and your alumni price. Anyone who has the link can open the page, so please keep it to yourself.
If you lose your member link, ask for a new one on the member page. The new link replaces the old one.
4. The free diagnostic and report
The diagnostic gives you a report based on your answers. It’s general guidance to help you think about your next steps. It isn’t legal, financial, tax or investment advice, and you make your own decisions.
5. Newsletter and waitlists
Our newsletter and waitlists are optional. We only add you after you confirm your email address. Every newsletter email has an unsubscribe link.
6. Buying ESC founding membership
6.1 Who can buy
By starting an order, you confirm and promise that:
- you are at least 18 years old and have full legal capacity to enter into a contract
- you live in Malaysia
- if you pay by card, the card was issued by a licensed financial institution in Malaysia
Being 18 or over, living in Malaysia and paying with a Malaysian-issued card are conditions of the contract. If you don’t meet them, there’s no contract.
We may check the card’s country and billing address at checkout. If a payment is made with a card issued outside Malaysia, we may cancel the order straight away, end access, cancel any instalment plan and refund the payment to the card you used. We currently refund the full amount. We keep the right to deduct the payment provider’s charges where the law allows. The refund and instalment policy explains this. You can instead pay once with FPX or GrabPay, or use a card issued in Malaysia.
6.2 What you’re buying
ESC founding membership is a lifetime membership of the Ecosystem Support Community. It includes coaching credits, onboarding intakes, access to the founders’ group, and the digital materials we have published for members. The ESC membership terms set out exactly what’s included, and what “lifetime” means.
6.3 Prices and tax
Prices are in Malaysian ringgit (RM). We aren’t registered for SST, so we don’t charge SST. The price you see is the price you pay.
The prices and payment options are set out in the ESC membership terms. You can pay once by card, FPX or GrabPay, or in 3 or 6 monthly card payments. A 12-month plan is available by request, at our discretion. For any instalment plan, we show the amount of each payment and the total before you pay, for example “3 monthly payments of RM 1,373, RM 4,119 in total”.
6.4 How an order works
- You choose how to pay and enter your details. Your order summary shows your price, your payment plan and the total you’ll pay. You can change any of your details, or your payment plan, before you continue.
- You tick a box to agree to these terms, the membership terms and the refund and instalment policy. Ticking the box is your electronic agreement to them under the Electronic Commerce Act 2006, and the contract forms when we accept your order (see 6.6). We record your email address, the date and time, a scrambled (hashed) copy of your IP address and the version of each of the three documents you agreed to.
- When you continue to secure payment, we hold a founding seat for you for 30 minutes. If you don’t finish paying in that time, the seat goes back into the pool.
- You pay on Stripe’s secure checkout page. We never see your full card details.
- Your order is complete when Stripe confirms your payment to us. Within 15 minutes we email you a welcome email with your member link, so you have access straight away. That email, and Stripe’s receipt, confirm we’ve received your order.
6.5 Receipts and e-invoices
Stripe emails you a receipt for each payment and each refund. These receipts confirm your payment. Payments show on your statement as HEXA PARTNERS.
If you’re a business and you need a validated e-Invoice under Malaysia’s e-invoicing rules, email hey@hexa.partners within 3 calendar days of your purchase with your Tax Identification Number (TIN), your business registration number and your billing details.
6.6 Mistakes in price
Prices on the site are an invitation for you to make an offer. A contract forms when Stripe confirms your payment and we accept your order.
If a price on the site is wrong because of a typing mistake, a software fault or a currency error, and the error is obvious, we may cancel the order, even after you’ve had a confirmation or receipt. We’ll tell you and refund everything you paid.
6.7 Instalment plans
If you choose 3 or 6 monthly payments (or a 12-month plan we have offered you), you allow us, through Stripe, to charge your card each month until the last payment. The plan then ends on its own. The refund and instalment policy explains what happens if a payment fails, and how to stop a plan.
6.8 The founding offer
The founding offer is for the first 150 members. It closes when 150 seats are paid, or when Release 2 (the release that opens our own community) launches, whichever comes first. We’ll post a notice on the site and email everyone on the waitlist when the offer closes. After that, you can join the waitlist.
7. Refunds
ESC has a 14-day money-back rule. It’s our own promise, and it goes beyond what Malaysian law requires. The refund and instalment policy sets out when it applies and how to ask.
8. Our content
We, or the people who license content to us, own the site and everything on it, including our frameworks, materials, text, designs and brand.
You can read the site and share links to its public pages. Members get a personal-use licence for our materials, explained in the ESC membership terms.
9. Services run by others
Some parts of our service use other companies’ platforms:
- Stripe for payments
- Google Calendar for booking sessions and calls
- WhatsApp for the founders’ group
Their own terms apply when you use them. We aren’t responsible for their outages or their own data practices.
10. Keeping the site running
We work to keep the site available and accurate. Sometimes it may be unavailable, for example during maintenance. We may change or remove parts of the site.
11. Our responsibility to you
Your legal rights. Nothing in these terms takes away or limits any right, guarantee or remedy you have under the Consumer Protection Act 1999 or any other Malaysian law that can’t be limited by agreement.
What we’re always responsible for. Nothing in these terms limits our responsibility for:
- death or personal injury caused by our negligence
- fraud, fraudulent misrepresentation or wilful misconduct
- anything else that Malaysian law doesn’t allow us to limit
What we’re not responsible for. Subject to the above, and as far as Malaysian law allows, we, our directors, employees, agents and coaches aren’t responsible to you for:
- loss of profit, business, contracts or opportunities
- loss of revenue, goodwill, reputation or expected savings
- loss or damage to data
- any special, indirect or knock-on loss, however it happens (in contract, negligence or otherwise), connected with the site, your membership, coaching sessions or our materials
A cap. As far as Malaysian law allows, our total responsibility to you for everything connected with a purchase is limited to the amount you paid for that purchase. For a plan that bills you regularly, it’s limited to what you paid in the 12 months before the event.
12. If something goes wrong
Email hey@hexa.partners and tell us what happened. We’ll work with you to put it right.
If you think a charge is wrong, please contact us before you ask your bank to reverse it. The refund and instalment policy explains what happens if a payment is reversed.
13. Changing these terms
We may update these terms, for example when the law changes or our service changes. The version and the date it takes effect are shown on this page.
The terms you agreed to when you bought apply to that purchase. If we make a change that materially affects what a current member gets, we’ll email you at least 30 days before it takes effect. If you reasonably object to a change that makes your membership materially worse, you can end your membership before the change takes effect, and we’ll give you a fair share of the value of your unused credits as store credit.
14. Law and disputes
These terms are governed by the laws of Malaysia.
You can always take a consumer complaint to the Tribunal for Consumer Claims (Tribunal Tuntutan Pengguna Malaysia) under the Consumer Protection Act 1999, where it applies. Apart from that right, the courts of Malaysia, sitting in Kuala Lumpur or Selangor, have exclusive jurisdiction over any dispute connected with these terms.
